Chapter 6 - THE EVICTION HEARING AMBUSH

The day of the emergency eviction and trust jurisdiction hearing arrived. The Maricopa County Superior Courthouse was cold and bustling. I sat at the plaintiff's table beside Marcus Vance, wearing a sharp grey suit, my documents neatly arranged in leather binders.

Across the aisle sat Beverly and Joanna. They looked vastly different from the polished socialites who had dominated the country club days ago. Without my financial backing, their expensive hair appointments had lapsed, their designer clothes looked rumpled, and their legal representation consisted of a cheap, overworked public defense attorney they had scrambled to hire at the last minute after their private retainer checks bounced.

Judge Arthur Pendelton, a formidable magistrate known for his zero-tolerance policy toward court games, slammed his gavel down.

"We are here today on Case No. CV-2026-00891: Arcadia Heights Holding LLC vs. Laura Vance, alongside the cross-motion regarding the Vance Family Heritage Trust," Judge Pendelton announced. "Counsel for the plaintiff, state your grounds for emergency eviction."

The overworked attorney stood up, sweating under his collar. "Your Honor, my clients, Beverly and Joanna Vance, represent the legal owner of the property, Arcadia Heights LLC. The defendant, Laura Vance, has failed to make mandatory residential payments and is occupying the premises illegally."

"Is that so?" Judge Pendelton looked down at Marcus. "Defense?"

Marcus stood up, calmly adjusting his suit jacket. "Your Honor, we move for an immediate dismissal of the eviction with prejudice, and request a ruling on our cross-motion for emergency sanctions and criminal referral."

Marcus stepped forward, handing a thick folder to the bailiff.

"What you have before you, Your Honor, are ten years of forensic bank audits. Beverly Vance, while acting as sole trustee of the Vance Heritage Trust, embezzled over $1.2 million intended for her grandchildren. She used $400,000 of those stolen funds to purchase the very condo my client lives in, placing it under a shell company to hide the paper trail. She then charged my client $3,500 a month in 'rent'—effectively forcing Laura to pay off the mortgage on a property bought with her own stolen trust money."

Judge Pendelton’s eyebrows shot up. He began flipping through the forensic accounting records, his eyes narrowing with every page.

"Furthermore," Marcus continued, his voice ringing through the silent courtroom, "when Laura Vance discovered the mistreatment of her daughter and ceased giving her mother and sister $18,000 in monthly personal handouts, the plaintiffs retaliated by filing a fraudulent police report, followed by a malicious false report with Child Protective Services."

Marcus handed over the certified DCS report, complete with the stamped criminal referral for Joanna Vance.

Beverly panicked. She leapt out of her chair, shoving her own lawyer aside. "Your Honor! That’s all lies! She’s an ungrateful daughter! She’s trying to steal my home and destroy my life! I am an old woman! She left me with no health insurance!"

"SILENCE!" Judge Pendelton slammed his gavel so hard the crack echoed like a gunshot. "Mrs. Vance, sit down immediately or I will hold you in summary contempt of court!"

Beverly collapsed back into her chair, breathing heavily, while Joanna buried her face in her hands, shaking uncontrollably.

Judge Pendelton reviewed the final document—the police report from the morning my mother had called 911 on five-year-old Maisie. The judge’s face turned thunderous.

"I have seen a lot of toxic family disputes in this courtroom," Judge Pendelton said, his voice dripping with disgust. "But the behavior of the plaintiffs in this case is among the most predatory, emotionally abusive, and financially fraudulent acts I have ever witnessed."
